High Court issues notice to Chief Secretary , Chairman Fare Controller

While hearing the petition filed challenging the appointment of the Fare Controller, the High Court has issued a notice to the Chief Secretary and Chairman of the Rent Controller of Chhattisgarh Government and directed them to submit their reply. The petitioner has accused the state government of violating its own rules and norms.
Raipur resident advocate NK Patel has filed a petition in Chhattisgarh High Court through advocate Sandeep Dubey. The petitioner has challenged the appointment period of the Chairman, Chhattisgarh Fare Controller. The petitioner says that the state government officials have openly violated the rules in the appointment of the fare controller. Citing the terms and conditions, he said that the maximum age for the post of Chhattisgarh Fare Controller Chairman has been fixed at 65 years. Apart from age, the most important condition and provision among other qualifications is that a retired District Judge will be appointed to this post. According to the petition, the criteria and qualifications set by the government for the appointment of the Chairman are not being followed by the concerned appointing department and officer. The petitioner told the court that Satish Singh has been appointed to the post of Chhattisgarh Fare Controller Chairman. His age is currently 67 years. The previous presidents have been appointed as per the criteria and rules of the state government. The prescribed age limit of 65 years was kept in mind. Petitioner’s advocate Sandeep Dubey told the court that the age limit for the appointment of fare controller members has also been fixed at 65 years. The current Chairman is more than 65 years old and continues to hold his post even today. At present his tenure is illegal due to it being contrary to the prescribed criteria and provisions. The petitioner has demanded cancellation of the appointment made against the prescribed criteria and rules.
The hearing of the petition took place in the single bench of Justice PP Sahu. After hearing the case, Justice Sahu has issued a notice to the Chief Secretary and Chairman Fare Controller of Chhattisgarh Government and directed them to submit their reply.
