Suspense over MLAship of Congress leader Devendra Yadav will end soon, HC reserves decision
1 min readRaipur (Team Newsbuddy): The High Court reserved the decision on the petition challenging the election of Bhilai Congress MLA Devendra Yadav. Former Speaker of the Assembly and BJP candidate Prem Prakash Pandey had filed this petition.
In the petition filed, Pandey said that Yadav has violated the Representation of the People Act and has hidden the information about his property in the nomination. Also, the criminal case was not mentioned in his affidavit, so his election should be canceled.
The petitioner said in his election petition that hiding the information of criminal cases and property from the Election Commission is a violation of the provisions. If a candidate hides such information, his election becomes illegal.
Raipur and Bilaspur Court had issued summons to Devendra Yadav, in which he has been declared a fugitive. Today, in the hearing held in the single bench of Justice Rakesh Mohan Pandey, advocate BP Sharma submitted an application on behalf of Devendra Yadav and said that the petition is not maintainable. After the hearing and arguments of all the parties were completed, the court has reserved the decision for the time being.
